The Supreme Court examined the applicability of Section 25H of the Industrial Disputes Act, 1947, regarding the re-employment of retrenched workmen from the Bhugatdih Rise Area Colliery, which was nationalized under the Coking Coal Mines (Nationalisation) Act, 1972. The Court upheld the High Court's ruling that the 111 workmen, retrenched prior to the nationalization date, were not entitled to claim employment as they were not in service on the appointed day, nor was their retrenchment set aside. The Court affirmed that Bharat Coking Coal Limited was not the successor-in-interest and thus not liable for the employment of the retrenched workers.
