The Supreme Court held that the provisions of Section 16G(3)(a) of the Uttar Pradesh Intermediate Education Act, 1921 do not apply to minority institutions, as clarified by Section 30 of the Uttar Pradesh Secondary Education Services Commission and Selection Board Act, 1982, which exempts minority institutions from the requirement of prior approval for termination of teachers. The Court found that the Allahabad High Court erred in relying on Regulation 44 as providing sufficient guidelines for the approval process, leading to the conclusion that the termination order was invalid. Consequently, the Supreme Court set aside the High Court's judgment and upheld the termination order by the Management of the minority institution.
