The Supreme Court held that an insurance company, as an assignee of a right to sue for loss of goods, does not qualify as a 'consumer' under the Consumer Protection Act, 1986, and thus cannot file a complaint against the carrier. Citing the cases of New India Assurance Company Ltd. v. B.N. Sainani and Oberoi Forwarding Agency v. New India Assurance Co. Ltd., the Court reaffirmed that a complaint by an insurer is not maintainable as they are not beneficiaries of the services provided to the consignor. The appeal was dismissed, upholding the lower court's decision.
