The Supreme Court upheld the eviction order under Section 10(2)(1) of the Tamil Nadu Buildings (Lease and Rent Control) Act, 1960, confirming that the tenant had defaulted in rent payment from the commencement of tenancy on 1st July 1988. The Court found that the tenant's claim of having sent a money order was unsubstantiated, as the money order was returned with the endorsement 'Addressee not found', and the landlord was out of town at the time. The Court held that the tenant's failure to pay rent constituted a default, thereby restoring the eviction order issued by the Rent Controller.
