The Supreme Court held that an insurance company, as an assignee of a claim for loss of goods, does not qualify as a 'consumer' under the Consumer Protection Act, 1986, and thus cannot file a complaint against the carrier. Citing New India Assurance Company Ltd. v. B.N. Sainani and Oberoi Forwarding Agency v. New India Assurance Co. Ltd., the Court reaffirmed that an insurer, even with a Letter of Subrogation, does not become a beneficiary of the service provided to the original consumer. The appeal was dismissed, upholding the lower court's decision that the complaint was not maintainable.
