The Supreme Court dismissed the appeal filed under Section 28(1) of the Maharashtra Recognition of Trade Unions & Prevention of Unfair Labour Practices Act, 1971, holding that the complaint was not maintainable as the members of the Appellant Union were not recognized as employees of the Respondent Company. The Court reiterated that disputes regarding employment status must first be resolved in an appropriate forum before a complaint under the MRTU & PULP Act can be made. The Court agreed with previous rulings that complaints under the Act can only be filed by those who are acknowledged as workmen.
