The Supreme Court addressed the legality of the High Court's revisional order under Section 25 of the Tamil Nadu Buildings (Lease and Rent Control) Act, 1960, which increased the fair rent from Rs.22,403 to Rs.28,000 per month. The Court held that the High Court erred in including the henpen and platform in the plinth area, as these structures do not constitute part of the building as defined under Section 2(2) of the Act. Consequently, the Court set aside the High Court's order, reaffirming the trial Court's and Appellate Authority's findings regarding the exclusion of these areas from the fair rent assessment.
