The Supreme Court held that an eviction order under Section 14(1)(d) of the Delhi Rent Control Act, 1958, cannot be validly issued against a lawful sub-tenant who has been in possession since before June 9, 1952, as per Section 16(1) of the Act. The Court found that the High Court erred in allowing the eviction despite concurrent findings by lower courts that the appellant was a lawful sub-tenant. The appeal was allowed, and the eviction decree was set aside, reaffirming the rights of the sub-tenant under the Act.
