Judgment text excerpt

The Supreme Court addressed the case of a Brigadier who sustained severe injuries during the 1965 Indo-Pak war, resulting in a 90% disability. The Court held that the adverse entries in his Annual Confidential Reports (ACRs) were unjustified and that he should not have been compelled to compete with able-bodied officers for promotion. The Court ruled that the High Court's decision to expunge the adverse comments and recognize his eligibility for promotion to Major General was valid, thereby allowing him to seek appropriate relief for his delayed promotion before retirement.
