The Supreme Court ruled that under the Air Cargo Tariff Rules, the carrier has a duty to inform the shipper about the arrival of goods and any failure to deliver constitutes deficiency in service under the Consumer Protection Act, 1986. The Court held that Air India was negligent for not notifying the consignees in Poland and failing to act on the appellant's instructions to reroute the goods to Sweden, resulting in financial loss to the appellant. Consequently, the Court upheld the appellant's claim for compensation due to the deficiency in service.
