The Supreme Court held that under Section 12(3) of the Specific Relief Act, 1963, a plaintiff can seek specific performance of part of a contract if they are ready and willing to perform their part. The Court found that the plaintiff was entitled to specific performance of the agreement for the patta land after relinquishing claims on the Sivaijama land, as the defendant had no title to the latter. The Court upheld the appellate court's decree for specific performance of the two acres of patta land, thereby allowing the plaintiff's appeal.
