The Supreme Court held that an eviction order under Section 14(1)(d) of the Delhi Rent Control Act, 1958, cannot be validly issued against a lawful sub-tenant who has been in possession since before 9th June 1952, as per Section 16(1) of the Act. The Court found that the High Court erred in allowing the eviction decree despite concurrent findings from lower courts affirming the sub-tenant's lawful status. Consequently, the eviction order was quashed, reinforcing the legal protections afforded to lawful sub-tenants under the Act.
