The Supreme Court examined the scope of Section 64 of the Narcotic Drugs and Psychotropic Substances Act, 1985, in relation to the grant of immunity from prosecution. The Court held that the Central Government can grant immunity even after a Sessions Judge has rejected a pardon application under Section 307 of the Code of Criminal Procedure, 1973, provided there are valid reasons for doing so.
