The Supreme Court held that under Section 31 of the Bombay Tenancy & Agricultural Lands Act, 1948, a tenant who has surrendered possession cannot claim restoration under Section 37 if the landlord has cultivated the land personally or through a tenant within the statutory period. The Court affirmed the findings of the Maharashtra Revenue Tribunal that the surrender was valid under Section 15 and that the widow of the landlord was entitled to cultivate the land through a tenant as per Section 2(6). Consequently, the appeal was dismissed, upholding the High Court's decision.
