The Supreme Court held that the promotion of respondent No.3 as Deputy Director (Health Services) was invalid as he did not meet the requisite qualification of ten years of service as mandated by Rule 9A of the Punjab Civil Medical (State Service Class I) Rules, 1972. The Court clarified that the notification dated 9th April, 1989, which treated PCMS Class II as PCMS Class I, did not eliminate the need for an amendment to the rules. Consequently, the Court set aside the High Court's decision and ruled that the Departmental Promotion Committee's recommendation was erroneous.
