The Supreme Court addressed the legality of the Excise Commissioner's decision to permit a bidder to shift the location of a liquor shop under the Kerala Abkari Act and the Kerala Abkari Shops (Disposal in Auction) Rules, 1974. The Court held that the Excise Commissioner acted within his authority under the statutory framework, and the High Court's quashing of the Commissioner's order was not justified. Consequently, the Supreme Court restored the Commissioner's order, allowing the bidder to operate the liquor shop in the new location.
