Judgment text excerpt

The Supreme Court upheld the decision of the Bombay High Court which interfered with the Appellate Authority's findings under the Central Provinces and Berar Letting of Houses and Rent Control Order, 1949. The Court found that the tenant was a habitual defaulter and had sub-let the premises, thus justifying the landlord's bona fide need for the property under Section 13(3)(ii), (iii), and (vi) of the Rent Control Order. The Court affirmed the High Court's conclusion that the Appellate Authority erred in its assessment of the tenant's default and sub-letting.
