Judgment text excerpt

The Supreme Court upheld the validity of the Will dated 12th June 1987 executed by Ms. Raj Mohini in favor of the Appellant, dismissing the claims of the Indian Red Cross Society based on the earlier Will dated 2nd April 1985. The Court emphasized that the later Will effectively revoked the earlier one, establishing the principle that a testator can revoke a Will at any time before their death. The Court affirmed the lower court's decision granting a Succession Certificate to the Appellant, thereby recognizing him as the legal heir entitled to the deceased's assets under Section 213 of the Indian Succession Act, 1925.
