The Supreme Court held that a compromise between the parties did not extinguish the decree for eviction under the Tamil Nadu Buildings (Lease & Rent Control) Act, 1960, but merely postponed its execution. The Court emphasized that since the compromise was not recorded by the executing court as per Rule 3 of Order 21 of the Code of Civil Procedure, the decree remained valid. The Court allowed the appeal, thereby reinstating the appellant's right to execute the decree for possession of the premises after the expiry of the lease period.
