Judgment text excerpt

The Supreme Court held that the termination of an employee who has worked for more than 240 days in a year is invalid if not conducted in accordance with the procedure laid out in Section 25F of the Industrial Disputes Act. The Court found that the High Court erred in its approach by not focusing on the key issue of procedural compliance for termination. Consequently, the Supreme Court reinstated the Labour Court's award for reinstatement with back wages and benefits, thereby allowing the appeal and setting aside the High Court's order.
