The Supreme Court held that under Section 14(1)(b) of the Tamil Nadu Buildings (Lease and Rent Control) Act, 1960, a landlord must prove that the building is in a dilapidated condition necessitating immediate demolition for reconstruction. The Court found that the High Court erred in reassessing evidence and overturning the findings of the Rent Controller and Appellate Authority, which had determined the building was not dilapidated and the landlord's need was not bona fide. Consequently, the Supreme Court set aside the High Court's judgment and restored the dismissal of the landlord's eviction petition.
