The Supreme Court ruled that under Section 44 of the Karnataka Land Reforms Act, 1961, all lands held by tenants immediately prior to the commencement of the Amendment Act vest in the State Government, regardless of any prior orders for resumption. The Court held that the appellant's concession in earlier proceedings under Section 14 of the Act did not negate his rights under the amended Section 44. Consequently, the Court set aside the decisions of the lower authorities that denied the appellant occupancy rights based on the earlier concession.
