Judgment text excerpt

The Supreme Court upheld the validity of the Indian Electricity (U.P. Amendment and Validation) Act, 1976, which amended Sections 6 and 7-A of the Indian Electricity Act, 1910. The Court ruled that the amendments did not violate any constitutional provisions and were within the legislative competence of the State. The appeal against the Calcutta High Court's dismissal of the challenge to the Ordinance and the Act was therefore dismissed, affirming the government's right to purchase the undertaking at the end of the license period.
