The Supreme Court addressed the applicability of the C.P. and Berar Letting of Houses and Rent Control Order, 1949, specifically clauses 2(4-A) and 13-A, in relation to a tenancy dispute. The Court held that the amendments to the Order, which included open plots in the definition of 'premises', were valid and that eviction could not occur without the landlord producing written permission from the Controller as mandated by clause 13-A. The Court remanded the case to the High Court for a fresh decision on the validity of the challenged clauses, thereby overturning the High Court's earlier ruling that deemed them ultra vires the C.P. and Berar Regulation of Accommodation Act, 1947.
