The Supreme Court held that an insurance policy taken on the same date as an accident does not automatically cover liability if the policy was issued after the accident, unless specified otherwise in the policy. Citing the principles from New India Assurance Co. Ltd. v. Ram Dayal and National Insurance Co. Ltd. v. Jikubhai Nathuji Dabhi, the Court clarified that if a policy explicitly states the time of issuance, liability commences only from that time. The appeal by the Insurance Company was dismissed, affirming the Tribunal's decision that the insurer was liable for the accident occurring before the policy's effective time.
