The Supreme Court held that adverse entries in the Annual Confidential Reports (ACRs) of the appellant from 1985-86 and 1986-87 could not be considered for promotion after the appellant was allowed to cross the efficiency bar on 20.5.92. The Court found that the adverse remarks from 1993-94, present at the time of selection in 1995, were subsequently deleted on 6.7.96, thus entitling the appellant to a fresh consideration for promotion. The appeal was allowed, directing the respondents to reconsider the appellant's case within three months without affecting the rights of other candidates.
