The Supreme Court held that when a Tribunal rejects an application, it should not make observations that could create rights for the applicant, as this is not proper legal practice. The Court found that the observations made by the Tribunal in its order dated 3rd July, 1997, while dismissing the application, are inconsequential and do not confer any rights. However, the Court allowed that the respondent's case may still be considered despite the lack of binding effect of the Tribunal's observations. The appeal was disposed of accordingly.
