Judgment text excerpt

The Supreme Court upheld the decision of the lower courts granting family pension to the respondent, a widowed sister of the deceased employee, based on the Punjab Civil Services Rules, 1960. The Court clarified that since the deceased did not opt for the 1964 Pension Scheme, the old rules apply, which include a widowed sister as a member of the family entitled to pension. However, the Court noted that to qualify for the pension, the respondent must prove dependency on the deceased, as stipulated in Rule 6.16-D of the Punjab Civil Services Rules.
