The Supreme Court addressed the applicability of Section 172(2)(a)(i) and Section 172(2)(a)(ii) of the U.P. Zamindari Abolition and Land Reforms Act, 1950, in determining inheritance rights following the death of a female Hindu Bhumidhar. The Court held that since Smt. Kaushalya Devi inherited self-acquired property from her father, she became an absolute owner, and upon her death, her husband, the appellant, was entitled to inherit the property under Section 174. The Court reversed the lower courts' decisions that favored the respondents' claim under Section 175, affirming the appellant's right to the property.
