The Supreme Court found that the Customs, Excise and Gold (Control) Appellate Tribunal had erred in not adequately addressing the absence of particulars like index number and strength in determining the transaction value of imported goods. The Court held that while the Tribunal was correct in rejecting the inflated price equivalent to German goods, it must reassess the transaction value based on appropriate evidence. The appeal was allowed, and the Tribunal was directed to hear the case afresh within four months, restoring Appeal No. 149/95A.
