Judgment text excerpt

The Supreme Court upheld the High Court's dismissal of a writ petition challenging the reduction of the 'Narayan Sarovar Chinkara Sanctuary' area under Section 26A(3) of the Wild Life Protection Act, 1972. The Court found that the State Legislature's resolution to reduce the sanctuary area from 765.79 Sq. K.M. to 444.23 Sq. K.M. was justified for economic development while ensuring wildlife protection. The Court affirmed that the remaining area was sufficient for the conservation of Chinkaras and that conditions imposed for industrial activities would mitigate environmental impacts.
