The Supreme Court held that a second complaint under the Consumer Protection Act is maintainable even if the first complaint was dismissed in default, as the dismissal does not bar a fresh complaint on the same cause of action. The Court clarified that the provisions of Order 9 Rule 9 CPC do not apply to consumer disputes, and the distinction in the parties named in the complaints (Branch Manager vs. Divisional Manager) further justified the second complaint. The Court upheld the decision of the District Forum allowing the claim for damages of Rs. 1,47,141.70 with interest.
