Judgment text excerpt
The Supreme Court held that under the Workmen's Compensation Act, 1923, the Insurance Company is not liable for penalties imposed, as established in Ved Prakash Garg v. Premi Devi. However, the Insurance Company remains liable for the payment of interest on the compensation amount. The Court clarified that while the penalty must be borne by the appellants, the liability for interest is shared between the appellants and the Insurance Company, thus disposing of the appeal accordingly.
