The Supreme Court held that the High Court erred in quashing the proceedings against the respondents under The Railways Property (Unlawful Possession) Act, 1966. The Court clarified that the Sub-Inspector of Railway Protection Force is indeed a 'police officer' under Section 173 of the Code of Criminal Procedure, thus allowing the Magistrate to take cognizance of the charge-sheet. The Court remanded the case back to the High Court for consideration of other contentions raised by the respondents that were not addressed previously.
