The Supreme Court held that under Section 11 of the Industrial Disputes Act, the Labour Court has the authority to set aside an ex parte Award if sufficient cause is shown. The Court found that both the Labour Court and the High Court erred in stating that the Labour Court had become functus officio after making the ex parte Award. The Court set aside the ex parte Award and restored the reference for fresh adjudication, directing the Labour Court to expedite the proceedings within six months. The appeal was allowed accordingly.
