The Supreme Court held that under the Pepsu Tenancy Agricultural Lands Act, 1955, a re-determination of surplus land is necessary under the Punjab Land Reforms Act, 1972 for proper vesting of land in the State Government. The Court found that the alleged allotment of land to respondents 5 to 10 was without authority of law due to the absence of such re-determination. Consequently, the appeal was allowed, and the orders of the High Court and Financial Commissioner were set aside.
