Judgment text excerpt

The Supreme Court held that the High Court erred in quashing the proceedings against the respondents under The Railways Property (Unlawful Possession) Act, 1966, as the inquiry conducted by the Railway Protection Force was valid under Section 8 of the Act. The Court clarified that the Sub-Inspector of the Railway Protection Force is indeed a 'police officer' within the meaning of Section 173 of the Code of Criminal Procedure, 1973, thereby affirming the Magistrate's jurisdiction to take cognizance of the case. The Court set aside the High Court's order and directed that the case be remanded for consideration of other contentions raised by the respondents.
