Judgment text excerpt

The Supreme Court held that the Labour Court's decision to uphold the dismissal of an employee for unauthorized dangerous driving was justified, as the punishment was proportional to the gravity of the misconduct. The High Court's order to appoint the employee as a cleaner on compassionate grounds was set aside, as the Supreme Court found no reason to substitute its discretion for that of the Labour Court. The appeal was allowed in part, maintaining the Labour Court's award while overturning the High Court's modification.
