The Supreme Court held that the Departmental Promotion Committee (DPC) of the State of Punjab was bound by the guidelines adopted from the Central Government on 1.10.1999, which required consideration of eight candidates for promotion to Chief Engineer, rather than five. The Court found that the omission of Ex. Major B.D. Gupta from consideration was improper, as he fell within the zone of consideration under the new guidelines. The Court upheld the High Court's directive for a fresh DPC meeting to include all eligible candidates, thereby setting aside the previous selection of the appellant and others.
