Judgment text excerpt

The Supreme Court ruled that Section 92 of the Evidence Act prohibits the introduction of parol evidence to modify or rescind the terms of a registered settlement deed. The Court held that the trial court erred in allowing oral evidence to substantiate a subsequent arrangement that purportedly altered the registered deed executed on 26.3.1915. Consequently, the High Court's decision to dismiss the suit filed by the plaintiff was upheld, affirming the validity of the registered settlement deed.
