The Supreme Court upheld the constitutional validity of Section 113 of the Tamil Nadu Town and Country Planning Act, 1971, rejecting the challenge that it violates Articles 14 and 21 of the Constitution. The Court found that the power granted under Section 113 is not uncanalised and is subject to guidelines derived from the Act and the Development Control Rules. The Court held that while it can review the orders passed under this section for arbitrariness, it does not warrant declaring the section itself as ultra vires.
