Sarabjit Singh vs Ex. Major B.D.Gupta & Others

The Supreme Court held that the Departmental Promotion Committee (DPC) must adhere to the guidelines adopted by the State of Punjab on 1.10.1999, which required consideration of eight candidates for promotion to Chief Engineer, rather than the five considered in the earlier DPC meeting on 16.4.1999. The Court found that the omission of Ex. Major B.D. Gupta from consideration violated his right to be considered for promotion under the new guidelines. Consequently, the Court upheld the High Court's directive for a fresh DPC meeting to include Gupta and others in accordance with the updated guidelines.
