The Supreme Court quashed the High Court's order dated 3.10.1996, which had quashed criminal proceedings against respondents under Sections 406 and 420 IPC, due to the failure to inform the appellant of a prior order dated 28.1.1995 that had dismissed a similar petition. The Court held that the High Court lacked the power to overturn its earlier decision based on facts that existed prior to that date. The Court allowed the respondents to seek discharge from the trial court while providing conditions for their personal appearance.
