The Supreme Court addressed the issue of seniority between direct recruits and promotees for the post of First Fireman under the Railway Establishment Manual. The Court held that the seniority of employees should be determined based on the date of regularization of their appointments, affirming that respondents 4 to 143, who were promoted on an ad hoc basis prior to the appellants' regular appointment, were entitled to seniority from their ad hoc appointment date. The appeal against the Central Administrative Tribunal's dismissal of the appellants' challenge was thus rejected, upholding the Tribunal's decision.
