The Supreme Court addressed whether an order granting a Succession Certificate under Section 373 of the Indian Succession Act, 1925 operates as res judicata in a partition suit between the same parties. The Court held that the Succession Certificate, being a summary proceeding, does not have the effect of res judicata in a regular civil suit, as it only provides indemnity to the debtor against future claims and does not determine the rights of the parties in a partition suit. Consequently, the Court upheld the High Court's dismissal of the second appeal on this ground.
