The Supreme Court set aside the High Court's order dated 13th January 1999, which dismissed the Appellant's review application on the grounds of merger with a prior order. The Court held that the dismissal of the Special Leave Petition (S.L.P.) as withdrawn did not preclude the Appellant from seeking a review based on factual inaccuracies in the High Court's order. The Court clarified that the review petition could still be tested for maintainability and errors apparent on the record, thus allowing the Appellant to pursue the review.
