The Supreme Court held that the tenant's argument that the premises in Sagarpur were covered by the Delhi Rent Control Act, 1958 was misconceived, as no notification had been issued under the proviso to Sub-section (2) of Section 1 of the Act to include Sagarpur in its Schedule. The Court clarified that despite the area being declared urban under the Delhi Municipal Corporation Act, the provisions of the Rent Control Act could not be applied without the requisite notification. Consequently, the appeal was dismissed, affirming the lower court's decree for ejectment and recovery of rent.
