The Supreme Court set aside the High Court's order dated 16th April 1999, which vacated the appointment of a Receiver made on 21st December 1998, solely due to the Appellant's absence on one occasion. The Court held that the absence of the Appellant did not justify the vacating of the Receiver's appointment and directed that the Receiver must provide another date for possession. The appeal was allowed, restoring the original order without costs.
