Judgment text excerpt

The Supreme Court held that under Section 163A of the Motor Vehicles Act, 1988, the claim for compensation due to the death of Dasarath Singh, a driver, was valid as it arose from an accident involving the use of a vehicle. The Court found that the High Court erred in classifying the incident as a murder rather than an accident under the Act. Consequently, the Court restored the Motor Accidents Claims Tribunal's award of Rs.2,81,500/- against the Insurance Company, affirming the liability of the insurer to compensate the deceased's family.
