Judgment text excerpt

The Supreme Court held that the role of the Public Prosecutor is distinct from that of the investigating agency, emphasizing that involving the Public Prosecutor in the investigation process is both unjudicious and legally impermissible. The Court found that the High Court's directive to the investigating officer to consult the Public Prosecutor and amend the charge-sheet was not permissible under law. Consequently, the Court set aside the High Court's order, reinforcing the independence of the investigation process as per Section 174(3) of the Code of Criminal Procedure.
